On June 1, 2005, the Federal Trade Commission adopted the FACTA Disposal Rule, establishing a company's legal responsibility to implement an information disposal program to mitigate consumer fraud and identity theft. As of May 2006, 15 states had passed also information disposal laws to prevent the unauthorized disclosure of personal information.
States are also passing breach notification laws, and the U.S. Congress will likely pass a federal breach notification law before the end of the year.
